Privacy Policy

Our privacy policy and how we use your data

Updated: September 1, 2025

1. Introduction

Welcome to Surfn ("Surfn," "Surfn.ai", "Surfn Solutions LLC," or "we"). Your privacy matters to us. This Privacy Policy explains how we collect, use, and protect your personal information when you use our services.

We know trust is the foundation of using AI tools. That's why we're clear on two things:

  1. We only collect the information we need to provide and improve Surfn.
  2. We will never sell your data.

This Policy applies to all users of Surfn, including free and paid accounts, and covers our website, platform, and any communications or integrations offered through Surfn. By using Surfn, you agree to the practices described here.

πŸ’‘
Simply put: This policy explains what we collect, why we collect it, and how we protect it. We only use your data to run and improve Surfn, and we'll never sell it.

2. Information We Collect

When you use Surfn, we collect certain information to provide, secure, and improve our services. This includes:

  • Account Information – When you sign up, we collect basic details such as your name, email address, organization name, and billing information (for paid plans).
  • Usage Data – We track how you use Surfn, including agent activity, chat transcripts, and performance analytics. We also use tools like Google Analytics to understand how people use our website and platform.
  • Content You Provide – To train and customize your AI agents, you may upload links, files, documents, media, or other content. This information stays yours β€” we just process it to power your agents.
  • Technical Data – We automatically collect information such as IP address, browser type, device type, operating system, and cookie data to ensure security and improve functionality.
  • Third-Party Integrations – If you choose to connect third-party services (e.g., Calendly, Google Sheets, YouTube), we may collect and process the information those services share with us to enable the integration.
πŸ’‘
Simply put: We collect the basics (account info, usage, and technical data), plus the content you upload and optional data from integrations β€” all to make Surfn work for you.

3a. How We Use Information

We use the information we collect for purposes that make Surfn safe, effective, and continually improving. Specifically:

  • To operate and improve Surfn – We use your information to power your AI agents, process the content you upload, monitor usage, troubleshoot issues, and keep the platform secure.
  • To communicate with you – We send transactional emails (like account updates, billing notices, and security alerts) as well as optional marketing emails and newsletters. You can opt out of marketing communications at any time.
  • To personalize your experience – We may use your preferences, usage patterns, and content settings to make your experience with Surfn more relevant and useful.
  • To comply with the law – We may use your data to meet legal, regulatory, or compliance obligations.
  • To generate insights – We may use aggregated and anonymized data (that can't identify you) for reporting, research, or to improve Surfn overall.
  • No AI Training – Surfn does not use your data or content to train generalized AI models. Your data is only used to power your own agents via retrieval-augmented generation (RAG).
πŸ’‘
Simply put: We use your data to run Surfn, keep it secure, communicate with you, and make the experience better. We may also use anonymized data for insights, but never sell your personal information.

3b. Aggregated Data

We may generate and use aggregated, de-identified data derived from your use of Surfn for purposes such as analytics, benchmarking, research, and improving our services. This information cannot reasonably be used to identify you.

πŸ’‘
Simply put: We may use anonymized data to spot trends and improve Surfn β€” but it can't be traced back to you.

4. Sharing & Disclosure

We respect your privacy and limit how your information is shared.

  • No selling – We never sell your personal information to third parties.
  • Service providers – We share information with trusted partners who help us operate Surfn (like hosting providers, analytics platforms, and payment processors). They can only use your data to perform services on our behalf.
  • Legal requirements – We may disclose information if required by law, legal process, or to protect the rights, safety, or security of Surfn, our users, or the public.
  • Business transfers – If Surfn is ever involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We'll notify you of any such change if it materially affects your rights.
πŸ’‘
Simply put: We only share your data with essential partners, if legally required, or if Surfn changes ownership. We never sell your data.

5. Cookies & Tracking

Like most online services, Surfn uses cookies and similar technologies to improve performance and understand how people use our platform.

  • Analytics – We use tools like Google Analytics and Mixpanel to gather insights on usage patterns, so we can make Surfn better. These tools may set cookies in your browser to help track page visits, traffic sources, and interactions.
  • Preferences & functionality – Cookies may also be used to remember your login, keep sessions secure, and save your preferences.
  • Your choices – You can manage or disable cookies through your browser settings. Please note that if you block certain cookies, some parts of Surfn may not work as smoothly.
πŸ’‘
Simply put: We use cookies to keep Surfn running smoothly and to learn how it's used. You're in controlβ€”manage cookies anytime in your browser.

6. Third-Party Services & AI Providers

Surfn relies on third-party providers to power certain features of the platform. This includes:

  • AI Providers – Surfn uses APIs from companies like OpenAI, Anthropic, Google, and others to generate responses and process requests. We don't control these providers, and their own privacy policies and terms govern how they handle data on their systems.
  • Integrations – If you connect Surfn with third-party services (like Calendly, Google Sheets, or others), you're choosing to share information with those services. Their use of your data is subject to their own privacy policies, not ours.
  • Limits of Control – While we carefully select our partners, Surfn cannot guarantee or take responsibility for how third-party providers or integrations handle your information.
πŸ’‘
Simply put: Surfn works with providers like OpenAI and Google, and connects with apps like Calendly or Google Sheets. Their rules apply too β€” we don't control what they do with your data.

7. Data Retention & Deletion

  • While You're Active – We keep your account data and agent content for as long as your account is active.
  • When You Delete Content – If you delete links, files, or agents, we'll remove them from our active systems within a reasonable period of time.
  • When You Close Your Account – If you cancel or close your account, we may retain your data for a limited period (for example, to comply with legal obligations, resolve disputes, or enforce agreements). After that, your data may be permanently deleted.
  • No Backup Guarantee – We are not responsible for maintaining backups of your content unless required by law. Please export any data you want to keep before closing your account.
  • Your Right to Delete – You can request deletion of your account and associated data at any time by contacting us at contact@surfn.ai.
πŸ’‘
Simply put: We keep your data while you're active. If you delete content or your account, it'll be removed after a period of time. Export anything you want to keep before leaving.

8. Security

We take security seriously and work hard to protect your data:

  • Safeguards – We use industry-standard measures such as encryption in transit, access controls, monitoring, and secure hosting to protect your information.
  • Shared Responsibility – No system is 100% secure. You are responsible for keeping your login credentials safe, using strong passwords, and restricting access to your account.
  • Ongoing Improvements – We regularly review and update our practices to keep pace with evolving threats and industry standards.
  • Abuse Prevention – We also implement rate limits and domain restrictions to help prevent abuse of your agents and protect your account from unauthorized use.
πŸ’‘
Simply put: We protect your data with strong security measures, but you need to keep your account credentials safe too.

9a. Your Rights

We believe you should have control over your data. Depending on where you live, you may have the following rights:

    • Request a portable copy of your data in a structured, machine-readable format.
  • How to exercise your rights:

Please email us at contact@surfn.ai. We may need to verify your identity before processing requests to protect your account and data.

πŸ’‘
Simply put: You can access, update, or delete your data anytime. EU/UK users get extra rights under GDPR. Just email us if you need help.

9b. California & U.S. State Privacy Rights

If you are a resident of California (or another U.S. state with similar privacy laws), you may have additional rights regarding your personal information. These may include the right to request details about the personal information we collect, request deletion, or opt out of certain uses. To exercise these rights, please contact us at contact@surfn.ai.

πŸ’‘
Simply put: California and some U.S. states give you extra privacy rights β€” just email us if you'd like to use them.

10a. International Transfers

Surfn is based in the United States, but we work with service providers and partners around the world. This means your information may be transferred to, stored in, and processed in countries outside of your home country, including the U.S.

  • For EU/UK users: When we transfer your personal data outside the European Economic Area (EEA) or UK, we rely on safeguards recognized under data protection law, such as the European Commission's Standard Contractual Clauses (SCCs), to ensure your data remains protected.

By using Surfn, you understand that your data may be processed in countries that may have different privacy protections than your own.

πŸ’‘
Simply put: Your data may be stored in the U.S. or other countries. If you're in the EU/UK, we use legal safeguards (like SCCs) to protect your data.

10b. Additional GDPR Compliance

πŸ’‘
Simply put: If your business needs a GDPR Data Processing Agreement, just email us and we'll provide it.

11. Children's Privacy

Surfn is not directed to children under the age of 18, and we do not knowingly collect personal information from anyone under 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete that information.

If you believe a child has provided us with personal information, please contact us at contact@surfn.ai.

πŸ’‘
Simply put: Surfn is for adults (18+). If we learn a child's info was shared, we'll delete it.

12. Changes to this Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will provide notice through email, in-app notifications, or by posting a clear notice on our website before the changes take effect.

We encourage you to review this Policy periodically so you're always aware of how we're protecting your information.

πŸ’‘
Simply put: If we change our Privacy Policy, we'll let you know through email, in-app, or our website.
